Souderton Area School Board's Issuance of Its Final Best Offer in Mandated Non-Binding Arbitration - September 26th, 2008
As of September 19, 2008, which coincides with the Teachers' Association's return to work, the Souderton Area School Board and the Souderton Area Education Association initiated mandated final best offer arbitration in accordance with Act 88 of 1992. Since September 19, 2008, the Souderton Area School District and the Souderton Area Education Association agreed upon the following:

  • Both parties have named their two interest arbitrators, namely: Donald Atkiss for the Souderton Area Education Association and Mark Fitzgerald for the Souderton Area School District.
  • The interest arbitrators have agreed upon the selection of Rochelle Kaplan, Esquire, to be the neutral arbitrator in the three-person arbitration panel.
  • The parties have also agreed that the arbitration panel will have the right to decide between the Board's Final Best Offer and the Association's Final Best Offer on an issue-by-issue basis. This means that the arbitration panel can select in its award either the Association's proposal, the Board's proposal, or carve some compromise between the two proposals on each one of the issues in dispute.

At its regularly scheduled public meeting on September 25, 2008, the Souderton Area School Board unanimously approved their Final Best Offer (PDF). The ten (10) day public comment period will commence once the Souderton Area Education Association submits its Final Best Offer. The Souderton Area Education Association's Final Best Offer should be received within ten (10) days of the initiation of the non-binding arbitration process, or on or before the close of business on September 29, 2008.
